MAP CARE Terms of Service

MAP CARE is operated by SAMYA PRABH HEALTHCARE PRIVATE LIMITED.

These Terms of Service govern access to and use of MAP CARE, including public onboarding surfaces, login and verification flows, the logged-in extension, protected workspaces, emergency entry flows, and related platform functionality.

If you do not agree to these Terms, do not use MAP CARE.

1. Platform Nature

MAP CARE is a technology platform.

MAP CARE:

  • does not itself provide diagnosis, treatment, prescriptions, or clinical judgment
  • is not itself a hospital, clinic, laboratory, pharmacy, ambulance operator, blood bank, or homecare provider
  • does not replace licensed professionals, statutory emergency channels, or medical advice
  • may provide governed access, visibility, workflow coordination, and payment initiation or payment-status visibility for eligible flows

Healthcare services remain the responsibility of the relevant provider or entity.

2. Eligibility and Accurate Information

By using MAP CARE, you represent that:

  • you are legally capable of using the platform or are acting through a lawful guardian or authorized representative
  • information you submit is accurate and not misleading
  • you will keep your account, contact details, and credential information reasonably current

3. SmartUser-Anchored Identity and Access

MAP CARE uses a governed identity model in which access may later extend to different access roles and protected workspaces, including SmartUser, professional, entity, staff, or other eligible operational lanes.

A person does not gain authority merely by reaching a surface, and protected workspace access remains subject to verification, eligibility, and runtime rules.

4. Account, Authentication, and Verification

MAP CARE may require:

  • signup and account creation
  • password-based authentication or other governed authentication methods
  • OTP verification
  • KYC or other verification steps for certain workflows or protected workspaces

MAP CARE may deny, restrict, suspend, or terminate access where it reasonably believes that:

  • information is false, deceptive, or unauthorized
  • a user is attempting misuse, fraud, abuse, scraping, or security interference
  • verification is incomplete, revoked, or inconsistent with platform rules
  • use of the platform creates legal, operational, safety, or governance risk

5. Consent-Dependent Flows

Use of certain MAP CARE functions depends on separate consent wording, including where applicable:

  • signup consent
  • OTP verification consent
  • medical data consent
  • KYC consent
  • emergency override consent

Withdrawal of a consent may disable the corresponding product capability without undoing lawful prior processing.

6. User Responsibilities

You agree that you will not:

  • impersonate another person or misstate authority
  • misuse emergency flows or trigger false urgent requests
  • attempt unauthorized access to protected workspaces, dashboards, or records
  • interfere with security, uptime, or workflow integrity
  • upload unlawful, malicious, or misleading content
  • use MAP CARE in a way that violates law, provider obligations, or another person's rights

You remain responsible for decisions you make using information visible through MAP CARE.

7. Payments, Billing, and Financial Boundary

MAP CARE may support payment initiation, payment-status visibility, billing visibility, or invoice-related workflows for eligible flows.

However:

  • healthcare-service charges remain governed by the relevant provider, entity, service, or contract lane
  • MAP CARE does not become the medical provider or guarantor of the underlying service merely because billing or payment information appears on the platform
  • refund, cancellation, and payment-failure handling is subject to the applicable MAP CARE policy set and the relevant external or provider-side flow
  • MAP CARE does not promise that every service or payment path will be available at all times

8. Public, Logged-In, and Protected Workspace Boundaries

MAP CARE contains different kinds of surfaces for different purposes.

Public onboarding and emergency surfaces do not grant operational authority. The logged-in extension is an access continuity layer, not a clinical workspace. Protected workspace access remains subject to the applicable identity, role, workflow, and visibility rules.

9. Emergency Limitation

MAP CARE emergency flows are facilitative only.

MAP CARE does not guarantee ambulance dispatch, blood availability, admission, response time, clinical prioritization, or emergency outcome. In a critical situation, users should also contact the appropriate local emergency channel.

10. Third-Party Services and Providers

Healthcare providers, payment partners, verification partners, and messaging or hosting providers may participate in the functioning of MAP CARE. Those parties may operate under their own contracts, terms, privacy policies, or statutory duties.

MAP CARE is not responsible for every act, omission, delay, network failure, or policy of an independent third party.

11. Intellectual Property and Content Use

MAP CARE and its related branding, software surfaces, content structure, and non-user proprietary materials remain the property of SAMYA PRABH HEALTHCARE PRIVATE LIMITED or its licensors, except where third-party rights apply.

You may use MAP CARE only for lawful and authorized platform use. You may not copy, scrape, reverse engineer, republish, or commercially exploit protected platform content except as allowed by law or by express written permission.

12. Availability, Changes, and Suspension

MAP CARE may add, modify, pause, or remove features, surfaces, or workflows when required for maintenance, governance, safety, compliance, product evolution, or operational reasons.

MAP CARE does not promise uninterrupted availability.

13. Disclaimer of Warranties

MAP CARE is provided on an as-available and as-governed basis. To the extent permitted by law, MAP CARE disclaims warranties not expressly stated in an applicable binding contract.

14. Limitation of Liability

To the maximum extent permitted by law, SAMYA PRABH HEALTHCARE PRIVATE LIMITED and MAP CARE will not be liable for:

  • clinical outcomes or treatment decisions made by a provider or user
  • emergency delays, failures, or third-party non-response
  • indirect, incidental, special, or consequential loss arising from platform use
  • reliance on third-party records, availability, or provider-side actions beyond MAP CARE's actual controlled role

Nothing in these Terms excludes liability that cannot lawfully be excluded.

15. Account Closure and Enforcement

MAP CARE may close, suspend, restrict, or preserve records associated with an account where reasonably required for security, safety, law, audit, or workflow integrity.

A user may request closure subject to the applicable deletion and retention policies.

17. Governing Law

These Terms are governed by the laws of India. Courts within India will have jurisdiction, subject to any mandatory legal requirement to the contrary.
